Terms of Service

1. Acceptance of Terms

By accessing or using PAG Tracker ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. The Service is provided exclusively for use by educational institutions in the United Kingdom.

2. Description of Service

PAG Tracker is a web-based application designed to help UK schools and colleges track A Level Science students' progress on Practical Assessment Group (PAG) activities, including outcomes against the Common Practical Assessment Criteria (CPAC) for Chemistry, Biology and Physics. The Service enables authorised staff to record, monitor and analyse practical-assessment data for students typically aged 16–18.

3. User Accounts

To use the Service, you must:

  • Be affiliated with a registered educational institution
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorised use of your account
  • Be at least 18 years old or have parental/guardian consent

4. Acceptable Use

You agree to use the Service only for lawful educational purposes. You must not:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorised access to any part of the Service
  • Interfere with or disrupt the Service or its servers
  • Share your account credentials with unauthorised persons
  • Upload malicious software or harmful content
  • Violate any applicable laws or regulations
  • Use the Service to process data of individuals outside your institution

5. Data Protection

You acknowledge that:

  • Your institution is the Data Controller for student ("pupil") data entered into the Service
  • PAG Tracker acts as a Data Processor on your institution's instructions
  • Processing is conducted in accordance with the UK GDPR and the Data Protection Act 2018
  • Your institution is responsible for ensuring an appropriate lawful basis and privacy information for pupils and staff
  • For maintained schools, processing pupil data is typically based on the performance of a public task (Article 6(1)(e) UK GDPR)
  • Student data is hosted and stored within the United Kingdom
  • Your institution must sign our Data Processing Agreement before any student data may be added to the Service (including creating cohorts or importing pupils)

5.1 How we access student data

PAG Tracker personnel do not access identifiable student data in the ordinary course of operating the Service. We access identifiable student data only where:

  • Your institution or an authorised user specifically requests support that requires it (for example, to investigate a problem you have reported); or
  • We are required to do so by law.

Any such access is limited to what is strictly necessary, is subject to confidentiality obligations, and is logged. Records of access by PAG Tracker personnel are maintained and can be provided to your institution on reasonable request, as described in the Data Processing Agreement.

5.2 Audit logging

The Service maintains audit logs of actions taken within the platform (such as creating, updating, exporting or deleting student or assessment records), including the acting user, the time of the action, and technical metadata such as IP address and browser information. These logs support your institution's accountability obligations and are available to your administrators. We do not sell student data and do not use it for advertising.

6. Intellectual Property

The Service, including its design, features and content, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute or reverse engineer any part of the Service without our written permission. Your institution retains ownership of all student data entered into the Service. Processing of that data is governed by the Data Processing Agreement between your institution and us.

7. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or in response to security concerns. We will make reasonable efforts to provide advance notice of planned maintenance.

8. Limitation of Liability

To the fullest extent permitted by law:

  • The Service is provided "as is" without warranties of any kind
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount paid by your institution in the past 12 months
  • We are not responsible for decisions made based on data from the Service

9. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

10. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason. Upon termination, your institution may request export of its data in accordance with our data retention policy.

11. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
